Courts pushing through legislation? Courts aren't supposed to legislate. That is what is wrong with our legal system now, and one of the reasons our civilization is going downhill. Judges basically 'legislate' from the bench based on their philosophy, not based on any real law besides case law, if that. The Supreme Court did that with gay marriage, as if 'due process' contained the idea of gay marriage all that time and previous courts were too dumb to see it.
