Family and friends ate pork roast and danced polkas to celebrate the union of a widow and a widower, both in their 70s, who had found unexpected love after the deaths of their long-time spouses.
For the next six-and-a-half years, Henry and Donna Rayhons were inseparable. She sat near him in the state House chamber while he worked as a Republican legislator. He helped with her beekeeping. She rode alongside him in a combine as he harvested corn and soybeans on his 700 acres in northern Iowa. They sang in the choir at Sunday Mass.
“We just loved being together,” Henry Rayhons says.
Today, he’s awaiting trial on a felony charge that he raped Donna at a nursing home where she was living. The Iowa Attorney General’s office says Rayhons had intercourse with his wife when she lacked the mental capacity to consent because she had Alzheimer’s. She died on Aug. 8, four days short of her 79th birthday, of complications from the disease. One week later, Rayhons, 78, was arrested. He pleaded not guilty.
To convict Rayhons, prosecutors must first convince a jury that a sex act occurred in his wife’s room at the Concord Care Center in Garner, Iowa, on May 23. If prosecutors prove that, his guilt or innocence will turn on whether Donna wanted sex or not, and whether her dementia prevented her from making that judgment and communicating her wishes.

As insane as this is, it is of course poetic justice in this case, since a legislator for the repugs is being hoisted by his own petard. How do you feel about all that feminist legislation you helped pass now, traitor? But it just goes to show that if you are not now part of the tiny parasitical elite, which is very well defined, you are now just another pleb to be victimized at will.

This is some messed up stuff. They are married. If they have sex while one of the have dementia, the government should stay out of it. If he isn't bruising her or making her bleed or vice versa, it's not the government's business.
I wonder if they will allow this to be covered in living wills. I told my wife if I'm in a coma, I want her to still have sex with me. She'd be too creeped out by that to do it. But I wouldn't want to miss out on 'consortion' just because I was in a coma. Who knows, it might wake me up? I wonder if some of these old guys who sleep with their wives in comas are just trying something else to wake them up. If I were in a coma and came out of it, I'd want my organs to be in good condition, well exercised, going forward.
I read that a court in Canada had decided it is rape to have sex with your spouse when your spouse is asleep, even if it is agreed on beforehand. That's also a case of immoral overreaching. If you consent beforehand, you consented. I don't know why these judges would want to infringe on the fun of married couples. For a woman, full blown sex with her while she's a sleep is generally not a very cool thing. Their bodies need a little more attention to be ready. But for guys, I don't like the idea of judges telling my wife she can't have a little fun with me while I'm asleep and wake me up in a fun way. (If only my wife were into that.

At the least, they would make it a matter of living wills. You should be able to put a section in there giving your spouse permission to use your body if you have dementia or if you fall into a coma. People with dementia shouldn't be deprived of their sexual relationship because of their illness. That's discrimination. They do have some lucid moments, and even if some old woman is totally out of it and asks her own husband for sex, there should be no case at all that that is rape. That's ridiculous. Now, if she hits on the mailman thinking he is her husband, and he knows she has dementia, sure prosecute the guy. But not her husband.
It used to be that the law recognized that sex was supposed to go on in marriage. Now, the fornication mentality has taken over the legal system and it's all about consent, the kind of sexual 'ethics' that are prevalent on college campuses.
If your wife gets dementia, I guess you could move to one of those Muslim countries where they believe it's okay to have sex with your wife's body for a while even after she is dead. Now that's the other extreme.

It's all about the state transferring his estate to them, forget about all this nonsence and just realize the system is designed to force the state to go after all property no matter how they can get it to stay afloat because the system eventually implodes because of debt servitude.
