The Fifth Amendment to the U.S. Constitution requires the government to pay just compensation when it takes private property for a public use. Does that apply when the government orders a business to close its doors indefinitely in order to help prevent the spread of COVID-19? Is the shuttered business entitled to compensation for its troubles?

Tony Roman has simply not closed his Italian restaurant in California through two lockdowns. The restaurant has a no-mask policy. The business is buzzing, guests travel from far and wide and sometimes wait up to five hours for a table. So far, Tony Roman has hardly had any trouble with the authorities. Well they're boomers. They were taught that making a fuss works. And it probably did back when they were young and the government was run by prior generations. They'll learn eventually if they don't die of Covid treatments before then.
