I used to be a fansubber and am friends with many cosplayers. If the cosplayer is posing in an area or event for photography, then it's assumed that he or she has given consent. But just because a cosplayer is in costume and walking around the convention, does not mean open season for photography. Cosplayers would really, really prefer it you ASK in advance so they can pose and look their best (at least in their mind), instead of "hit and run" photos of questionable quality that gets posted online.
