A small victory for men in Quebec...for now

Post by Andrewww »

http://www.theglobeandmail.com/news/nat ... le7847079/

These fuckers were thinking of screwing every decent man in Quebec smart enough not to enter marriage. I would like to know how does this violate the right to equality ? Since when is divorce equal when the bitch takes your salary, your children AND your f***ing house? It just shows how messed up this country has become.
The Supreme Court of Canada has ruled that Quebec can continue to exclude common law couples from receiving spousal support upon the breakdown of a relationship.

A majority found that Quebec’s exclusion does violate the Charter right to equality.

However, a complicated split on the court led to a narrow 5-4 vote in favour of leaving the unconstitutional law intact.

The decision means that Quebec continues to march in a different direction than the rest of the country on common law spousal rights.

About 1.2 million Quebec residents are potentially affected by the decision - the largest concentration of unmarried couples in the world.
And if you think feminism is a myth, the ramblings of some frustrated chaps well the whole article:
Gender lines were evident in the decision.

Four of the five male judges – Mr. Justice Louis LeBel, Mr. Justice Morris Fish, Mr. Justice Marshall Rothstein and Mr. Justice Michael Moldaver – concluded that the exclusion of common law couples from spousal support simply did not violate the right to equality.

All four female judges on the court concluded that it did.

Scary.

So in the rest of Canada, you and your honey would need separate addresses to keep the feds out of your bedroom?
"Well actually, she's not REALLY my daughter. But she does like to call me Daddy... at certain moments..."

Pretty much...in the rest of Canada after you live together for 2 or 3 years (depending on province) she will have the same rights as a spouse.
That means your assets and house will be divided if she decides to take legal action even if you don't have children.

In Quebec there is no such thing. As long as you don't get married you get to keep your wealth. Of course you'll have to pay child support but at least you can kick out the bitch.

I can see you have strong feelings about this. So you don't have to live together for a set time in Quebec like 2 years and 364 days, to become "partners" according to this: http://divorce-canada.ca/common-law-mar ... -in-canada

If you have to pay child support, guys should go on welfare before the judgement - fake a back injury, etc.

It seems I was mistaken. In common law the woman can get part of your property but only if she can prove that she has invested money into it.

The victory in Quebec is only related to alimony.
